Terms and conditions

Preamble

Madam Anne Rigaud‑Walker practises as an RTT® practitioner (Rapid Transformational Therapy®), certified Havening® practitioner, Safe and Sound Protocol (SSP) practitioner, MindsetMaps™ practitioner, Logosynthesis practitioner, energy therapist and professional coach (executive coaching and personal coaching). She acts as an individual entrepreneur under French law, registered in the Trade and Companies Register under no. SIRET 898 998 778 00010 (hereinafter “the Coach/Therapist”). The headquarters is located at 25 rue du Bois Saint‑Père – 92500 Rueil‑Malmaison.

Article 1 – Services

The Coach/Therapist offers a range of services aimed at improving the mental, emotional and/or physical well‑being of her clients:

  • Rapid Transformational Therapy® (RTT®): according to the protocol described in your current Terms and Conditions (initial consultation, hypnotherapy session, transformation audio module and feedback session).

  • Havening®: psycho‑sensory technique based on touch intended for the management of traumas and the optimisation of resources. Sessions generally last between 1 hour and 2 hours and include an anamnesis phase, Havening cycles and a debriefing.

  • Safe and Sound Protocol (SSP): therapeutic listening method that takes place over several sessions of about 30 minutes to 1 hour each, together with personalised support and at‑home practice recommendations.

  • MindsetMaps™: assessment and development tool that includes an initial inventory (questionnaires, online tests) and analysis and feedback sessions, which can be supplemented by a detailed report and coaching modules.

  • Professional and personal coaching: individual or company‑based accompaniment, in person or remotely, focused on skills development, leadership, emotional management, career direction and the alignment of personal/professional life. These sessions generally last one hour and may be part of personalised multi‑session programmes.

  • Other complementary techniques: depending on the client’s needs and goals, the Coach/Therapist may resort to mental preparation tools, visualisation, breathing, energy rebalancing or relaxation, specified during the initial session.

All these services can be combined or adapted according to the client’s needs. The details (duration, terms and number of sessions) are defined by mutual agreement during the first consultation.

The services can be delivered at the office, in a company or via videoconference, after acceptance of these general terms electronically.

Article 2 – Price and payment terms

The price of the services is communicated to the client prior to any intervention and varies according to the nature of the support (RTT®, coaching, Havening®, SSP, MindsetMaps™, etc.), the duration and the number of sessions planned. Unless otherwise stated, full payment is due before the first session by bank transfer or any other means of payment accepted by the Coach/Therapist.

In case of impediment, any appointment must be cancelled or postponed at least 24 hours in advance. Failing this, the scheduled session remains due and non‑refundable, except in cases of force majeure. Payment delays give rise to penalties equal to three times the legal interest rate and a flat-rate indemnity of € 40 for recovery costs, in accordance with the regulations in force.

Article 3 – Nature of obligations and liability

The services offered fall under an obligation of means: the Coach/Therapist uses her skills, experience and appropriate techniques to allow the client to achieve his or her objectives. The result depends essentially on the client’s commitment to the process and cannot be guaranteed.

None of the techniques used (RTT®, coaching, Havening®, SSP, MindsetMaps™, etc.) replaces a medical consultation, diagnosis or treatment prescribed by a health professional. The client remains responsible for his or her health and must, in case of doubt, consult a doctor or an emergency service able to assess his or her condition. The Coach/Therapist cannot be held liable for the absence of results or for any indirect damages linked to the service.

Article 4 – Confidentiality and protection of personal data

4.1. Non‑disclosure:
The Therapist undertakes, during the entire duration of the RTT® and for a period of fifteen years after the last session, for any reason whatsoever, to complete confidentiality, refraining from disclosing, directly or indirectly, any information obtained in the context of the RTT®. The Rapid Transformational Therapy® protocol is a method protected by trade secrets, and you undertake not to reveal the TTR © method without prior authorisation.

4.2. Personal Data:
The Therapist collects your data in her capacity as data controller, for the purpose of providing the agreed service, namely name, first name, email address, telephone number. The processing of personal data implemented has as legal bases the contractual execution of the service, as well as the legitimate interest of the Therapist (invoicing, legal newsletter, proof of performance). The Therapist does not collect any health data nor any sensitive data within the meaning of the GDPR. The office pursues a legitimate interest in making its services known, sending promotional or commercial information, general or personalised, or organising events, unless you oppose such mailings or later withdraw your consent, by email sent to anne@arwcoach.fr. The Therapist ensures compliance with legal and regulatory obligations when she implements processing for accounting purposes.

The office only retains data for the period necessary for the operations for which they were collected and in compliance with the regulations in force, according to the following durations:

The data processed are intended for authorised persons of the AR practice. External recipients are: chartered accountant, billing management solution, email service, videoconferencing solution.

Certain external service providers, subcontractors, process the personal data entrusted outside the European Union. In this case, the European Commission’s standard contractual clauses are provided, in addition to any additional guarantees that may be necessary. Under the conditions defined by the French Data Protection Act and the European Data Protection Regulation, natural persons have a right of access to data concerning them, rectification, opposition, limitation, portability and deletion. Data subjects also have the right to object at any time, for reasons related to their particular situation, to the processing of personal data whose legal basis is the legitimate interest of the practice, and the right to object to commercial solicitation, by writing to anne@arwcoach.fr. Data subjects have the right to lodge a complaint with the CNIL by writing to 3 Place de Fontenoy – TSA 80715 – 75334 PARIS CEDEX 07, or by phoning 01 53 73 22 22.

Article 5 – Intellectual property

The RTT® protocol and the transformation audio module are tools protected by intellectual and industrial property law. You undertake not to reproduce, make available to the public, disclose or exploit in any form whatsoever, directly or indirectly, all of the elements used or made available to you for the purposes of this Rapid Transformational Therapy.

Article 6 – Miscellaneous

6.1. Non‑assignability:
This contract being concluded intuitu personae, it may in no case be assigned or transferred, nor the rights and obligations contained therein to any person, and in any form whatsoever, by either of the Parties without the prior written consent of the other Party.

6.2. Force majeure:
The Parties shall not be held responsible, or considered as having failed under these presents, for any delay or failure to perform their obligations, when the cause of the delay or non‑performance is due to a case of force majeure, as defined by French law and courts.

6.3 Partial nullity:
The nullity or inapplicability of any of the stipulations of the Contract shall not entail the nullity of the other stipulations which will retain all their force and scope. However, the Parties may by mutual agreement agree to replace the invalid clause(s).

Article 7 – Governing law

The Contract is governed by French law.
